Appeal of Gainful Employment Decision

The American Association of Career Schools (AACS) is pleased to share that we have joined forces with Ogle School Management and Tricoci University of Beauty Culture to continue the legal fight against the U.S. Department of Education’s Gainful Employment (GE) rule.


Together, the parties have retained former U.S. Solicitor General Paul Clement and the law firm Clement & Murphy PLLC to file an appeal of the district court’s decision in the U.S. Court of Appeals for the Fifth Circuit.


This coordinated effort reflects our shared commitment to:



  • Defend students’ access to high-quality career, beauty, barber, and wellness education
  • Challenge what we believe are unlawful and unworkable aspects of the GE rule
  • Protect institutions that serve nontraditional, low-income, and working adult students


While we cannot predict the outcome of the appeal, AACS remains committed to using every available avenue—legal, legislative, and regulatory—to advocate for fair, consistent, and transparent accountability standards that do not unfairly target our sector or harm the students we serve.


We will continue to keep our members updated as the appeal progresses and as key milestones occur in the Fifth Circuit.
